Position SummaryThe Attorney is responsible for representing the company in litigation matters focusing on collecting healthcare receivables.Essential Duties of the PositionHandle payment disputes as requested by company/client, as well as estate, bankruptcy, receivership, and worker's compensation issues related to collection of receivables.Review and sign collection demand letters daily.Provide legal direction/advice for collection procedures within the company.Handle all aspects of Lien process on 3rd party auto injury cases.Advise company employees on various aspects of the law, including Fair Debt or Fair Credit Reporting acts, balance billing statutes, bankruptcy stays, Risk Management issues, and any other collection related statutes, rules, or regulations.Serve as liaison between company and client for settlement offers.Maintain expertise on legal issues and federal regulations regarding collection operations of company.Conduct legal research as needed.Review and sign suits, prosups, dismissals, continuances daily.Attend court when scheduled.Review and respond to correspondence and phone calls daily.Update court reports daily.Work accounts in 5ATY disposition weekly. The Attorney needs to be aware of all changes in the laws. Although the Attorney has the ability to make independent decisions on how to proceed with cases, the Attorney always has to make sure the Client interests are protected. Advice and guidance may be sought from the Senior Attorney as warranted to ensure the provision of quality service. ResponsibilityThe Attorney position has a high level of responsibility. Any error could result in a potential FDCPA violation. The Senior Attorney has weekly meetings with each Attorney to make sure the Attorney is following procedures.Personal Work Relationships The employee must deal with a variety of staff levels, conditions and circumstances. Routine contacts are to be expected from incoming calls, outgoing calls, management, and interdepartmental associates.
